Levy of Distress for Rent refers to the act of seizing and selling by public auction tenant’s property to recover outstanding rent arrears. The Distress for Rent Act Chapter 293 Laws of Kenya donate the Landlord the power to authorize his/her licensed Auctioneer to seize the assets of the tenant to recover owed rent in arrears.
This is non-judicial remedy available to landlords. The landlord only needs to instruct Upstate Kenya Auctioneers in writing for us to commence the rent recovery process. The landlord may instruct us directly or through his agents. We have executed several distress for rent instructions over the years thereby recovering rent arrears to the benefit of our clients.
